6. Notifiable Matters — Credit Reporting
The law requires us to advise you of the following notifiable matters regarding your credit-related information. You may request this policy, including these notifiable matters, in an alternative format by contacting us.
We exchange your credit-related information with CRBs to confirm your identity, assess your creditworthiness, assess your application for finance or your capacity to act as a guarantor, and manage your finance.
The information we may exchange with CRBs includes your identification details, the type and amount of credit you hold, whether you have met your repayment obligations, whether you have entered into a financial hardship arrangement, and whether you have committed a serious credit infringement.
If we seek information about you from a CRB in connection with a credit application (a “credit enquiry”), your consent to that enquiry is not required. A record of the credit enquiry may be used or disclosed for the purposes of assessing your creditworthiness, including calculation of a credit score. Multiple credit enquiries over a short period may negatively impact your credit score.
If you fail to meet your payment obligations or commit a serious credit infringement, we may disclose this information to a CRB.
You have the right to request access to the credit-related information we hold about you and to request a correction if needed (see section 12). You also have the right to make a complaint to us about the handling of your credit-related information (see section 14).
Sometimes your credit-related information may be used by CRBs for the purposes of pre-screening credit offers on behalf of other credit providers. You may contact the relevant CRB at any time to request that your information not be used in this way.
If you believe you may have been a victim of fraud, you may notify a CRB. CRBs must not use or disclose your credit-related information for 21 days after you advise them of this. You can contact the following CRB:
Equifax Pty Limited — www.equifax.com.au — 13 83 32 — Privacy policy: www.equifax.com.au/privacy
7. Sensitive Information
We will only collect sensitive information about you (including health information, racial or ethnic origin, criminal record or other sensitive categories as defined in the Privacy Act) with your consent, where required by law, or where necessary for our services.
If you are making a hardship application, we may ask you about medical conditions that are relevant to that application.
8. Security and Overseas Disclosure
We take reasonable steps to protect your personal and credit-related information from misuse, interference, loss, unauthorised access, modification or disclosure. This includes physical security measures (such as secure premises and locked storage) and technology security measures (such as firewalls, encryption, access controls and anti-virus software).
Information is stored in secure electronic systems and may also be held in paper form. We may use cloud storage, and some servers or service providers may be located outside Australia. Overseas recipients may be located in countries including the United States, the Philippines and Singapore
Before disclosing your information to an overseas recipient, we will take reasonable steps to ensure that:
- The overseas recipient does not breach the APPs; or
- The overseas recipient is subject to a law or binding scheme that provides a level of protection substantially similar to the APPs, with accessible enforcement mechanisms; or
- You have consented to the disclosure.
Please be aware that overseas entities may be required to disclose your information to relevant foreign authorities under applicable foreign law.
9. Retention and Destruction of Information
We retain your personal and credit-related information only for as long as necessary for our business and legal obligations. In most cases, information is retained for a minimum of 7 years from the date of the last transaction or conclusion of your finance arrangement, in accordance with our AML/CTF and other regulatory obligations.
When your information is no longer required, we will take reasonable steps to securely destroy or permanently de-identify it.
10. Identity Verification — Document Verification Service (DVS)
To verify your identity, we may collect, use and disclose information derived from your government-issued documents (such as your Australian passport, driver’s licence, Medicare card, citizenship certificate or birth certificate) to the relevant government agency via the DVS, provided we have obtained your express consent.
Our use of the DVS may involve third-party systems and services, including Equifax. The DVS verifies your information by checking it against records held by the issuing government agency.
You may withdraw your consent at any time by contacting us. If you do not provide evidence of your identity or consent to DVS verification, we may be unable to provide products or services to you.
We do not collect or retain facial images for identity verification purposes. If this changes, we will inform you of how such images will be used, disposed of, and whether they will be retained.
